Terms of Service

Welcome to LooksMatch. These Terms of Service ("Terms") govern your use of the LooksMatch mobile application ("App") operated by LooksMatch ("we," "our," or "us"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years of age to use LooksMatch. By creating an account, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the App under any applicable law
• You have not been previously banned or removed from the App

We reserve the right to request age verification at any time and to terminate accounts that we believe belong to users under 18.

2. Account Creation and Responsibility

• You must provide accurate, current, and complete information when creating your account.
• You are solely responsible for maintaining the confidentiality of your login credentials.
• You may not create more than one account per person.
• You may not use another person's account or impersonate another person.
• You are responsible for all activity that occurs under your account, whether or not authorized by you.
• You must notify us immediately if you suspect unauthorized access to your account.

You may sign in using email/password, Apple Sign-In, or Google Sign-In. Regardless of the authentication method used, these Terms apply in full.

3. User Content

You retain ownership of all photos, text, and other content you upload to the App ("User Content"). By uploading User Content, you grant LooksMatch a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your User Content within the App solely for the purpose of providing and improving our services.

This license terminates when you delete your User Content or your account, except where your content has been shared with other users (e.g., messages) and they have not deleted it, or where we are required by law to retain it.

4. Content Guidelines

All photos and content you upload must comply with the following rules. You agree that your User Content:

• Is of yourself: All profile photos must be of you. No impersonation, catfishing, or use of others' likenesses.
• Is appropriate: No nudity, sexually explicit material, graphic violence, or disturbing imagery.
• Is legal: No content that is illegal, promotes illegal activities, or depicts illegal substances.
• Respects others: No content that harasses, bullies, threatens, defames, or discriminates against any individual or group.
• Is original or licensed: No content that infringes on any third party's intellectual property, copyright, or trademark rights.
• Is not spam: No commercial advertising, solicitation, or promotional content.

We reserve the right to remove any User Content that violates these guidelines, at our sole discretion, with or without notice.

5. Acceptable Use Policy

When using LooksMatch, you agree not to:

• Use the App for any unlawful, fraudulent, or malicious purpose
• Harass, stalk, threaten, intimidate, or abuse any other user
• Send unsolicited commercial messages, spam, or chain letters
• Create fake accounts, use bots, or operate multiple accounts
• Manipulate scores, rankings, or leaderboard positions through artificial means
• Scrape, crawl, or harvest user data or content from the App
• Reverse-engineer, decompile, or disassemble any part of the App
• Circumvent or attempt to circumvent rate limits, security features, or access controls
• Upload malware, viruses, or any malicious code
• Use the App to solicit money or financial information from other users
• Share your account credentials with others or allow others to access your account
• Use the App in any manner that could damage, disable, or impair the service

6. AI Scoring Disclaimer

LooksMatch uses machine learning models to generate attractiveness scores based on facial geometry analysis. You acknowledge and agree that:

• Scores are algorithmically generated and reflect the output of machine learning models, not human judgment.
• Scores are inherently subjective and may be influenced by factors including photo quality, lighting, angle, and model limitations.
• Scores do not represent an objective or definitive measure of attractiveness, beauty, or personal worth.
• Scores may vary between scans of the same person.
• We make no guarantees regarding the accuracy, consistency, or fairness of AI-generated scores.
• LooksMatch is not responsible for any emotional distress, psychological impact, or other harm arising from your score, ranking, or ratings from other users.

By using the Face Scan feature, you consent to the collection and processing of facial geometry data as described in our Privacy Policy.

7. Matching and Messaging

LooksMatch facilitates connections between users through swiping, matching, and messaging features. You understand and agree that:

• We do not guarantee any matches, connections, or successful relationships.
• Mutual matches are required before messaging is enabled between two users.
• You will treat all users with respect and dignity in all interactions.
• You will not send harassing, threatening, sexually explicit, or abusive messages.
• You will not use messaging for spam, solicitation, or commercial purposes.
• We reserve the right to monitor messages for compliance with these Terms when investigating reported violations.

8. Leaderboard and Rankings

The App features a leaderboard that ranks users based on their AI scores and community ratings. Leaderboard positions are calculated algorithmically and update regularly. We reserve the right to modify the leaderboard algorithm, ranking criteria, and tier system at any time without prior notice.

9. Premium Subscriptions and In-App Purchases

9.1 Premium Features

LooksMatch offers optional premium features and subscriptions that may include, but are not limited to: additional face scans, profile boosts, the ability to see who liked you, advanced filters, and other enhanced features. Premium features and their availability are subject to change.

9.2 Payment and Billing

• All purchases are processed through the Apple App Store or Google Play Store. Payment terms are governed by the respective platform's terms of service.
• Subscription fees are billed in advance on a recurring basis (weekly, monthly, or annually, depending on the plan selected).
• Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
• You can manage and cancel your subscription through your device's App Store or Google Play settings.

9.3 Refunds

All purchases are final. Refund requests must be directed to Apple or Google, as applicable, in accordance with their refund policies. We do not process refunds directly.

9.4 Free Trials

We may offer free trial periods for premium features. If you do not cancel before the trial ends, you will be charged the applicable subscription fee. Unused portions of free trials are forfeited upon purchasing a subscription.

10. Identity Verification

LooksMatch may offer optional selfie verification to help confirm that you are who you say you are. By opting into verification, you consent to having your selfie captured and compared to your profile photos. Verification is voluntary and does not guarantee the identity or trustworthiness of any user. The absence of a verification badge does not imply that a user's profile is fake or untrustworthy.

11. Intellectual Property

The App, including its design, code, algorithms, machine learning models, branding, logos, graphics, and all other intellectual property, is owned by LooksMatch and is protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute any part of the App without our written permission
• Use the LooksMatch name, logo, or branding for any purpose without our written consent
• Create derivative works based on the App
• Use our intellectual property in any manner that is misleading or defamatory

12. Blocking and Reporting

You may block any user at any time to prevent them from viewing your profile or contacting you. You may report users who you believe are violating these Terms. We review all reports and may take action at our sole discretion, including issuing warnings, temporary suspensions, or permanent account termination.

13. Account Suspension and Termination

13.1 Termination by You

You may deactivate or permanently delete your account at any time through the App's Settings. Deactivation hides your profile for up to 30 days and allows reactivation. Permanent deletion removes all your data irreversibly.

13.2 Termination by Us

We reserve the right to suspend or terminate your account, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms or our Content Guidelines
• Fraudulent, abusive, or illegal behavior
• Creating fake profiles or impersonating others
• Receiving multiple reports from other users
• Manipulating scores or rankings
• Any conduct that we determine, in our sole discretion, is harmful to other users, the App, or the LooksMatch community

If your account is terminated for a violation of these Terms, you are not entitled to a refund for any purchases made.

14. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or free of harmful components
• Any matches or connections will result in successful relationships
• AI scores or rankings are accurate, fair, or consistent
• Other users' profiles, photos, or information are truthful or accurate
• The App will meet your specific expectations or requirements

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOOKSMATCH AND ITS FOUNDERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Emotional distress or psychological harm from scores, rankings, ratings, or interactions with other users
• Loss of data, revenue, or profits
• Personal injury or property damage resulting from interactions with other users
• Unauthorized access to or alteration of your data
• Any conduct of third parties on the App

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO LOOKSMATCH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

16. Indemnification

You agree to indemnify, defend, and hold harmless LooksMatch and its founders, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the App, your User Content, your violation of these Terms, or your violation of any rights of another person or entity.

17. Dispute Resolution

17.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us at support@info.looksmatchapp.com and attempt to resolve the dispute informally for at least 30 days.

17.2 Binding Arbitration

If the dispute cannot be resolved informally, you and LooksMatch agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved through binding arbitration, rather than in court, except that either party may seek injunctive or equitable relief in court for intellectual property disputes.

17.3 Class Action Waiver

You agree that any disputes will be resolved on an individual basis and that you will not bring or participate in any class action, collective action, or representative proceeding against LooksMatch.

17.4 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms in the App and updating the "Effective Date" at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the App and delete your account.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LooksMatch regarding your use of the App and supersede all prior agreements, understandings, and communications.
